In the following, the key points of trademark practice are presented analogously. The explanations are based on the Guidelines for Trademark Questions of the IGE in Bern.

Origin of trademark protection

a)
Registration in the Trademark Register by filing the identity of the applicant and the representation of the trademark. The filing date establishes the trademark and determines the seniority in case of identical applications.

b)
Trademark protection may also be established by notoriety (Art. 3(2)(b) MSchG), or

c)
by use, provided that the trademark has acquired a reputation. This is the case if a substantial part of the customers associate this trademark with a company.
